Details of Participation

Information on how to enter forms part of these Details of Participation and entry is deemed as acceptance of them. No purchase is necessary to enter contest or redeem prizes. Contest commences 23/01/12 at 9:00am AEST and entries close 01/07/12 at 11:59pm AEST. Five prizes to be given away. Entries not received by that time or not completed in accordance with these Details of Participation will not be eligible to win.

Grand Prize: One grand prize only, winner to receive AUD$2,000 Cash and 50,000 ‘One-Time Credits’ valued at AUD$9,500 (based on $0.19 per Credit). Minor Prizes: Four minor prizes only, winners to receive AUD$2,000 Cash and 2,000 ‘One-Time Credits’ valued at AUD$380 (based on $0.19 per Credit) Total Prize Value: AUD$21,020. If for any reason a prize is not available, the Promoter reserves the right to substitute another item for it, in its sole discretion, of equal or higher value, subject to the approval of the gaming authorities in each State/Territory, where relevant. All prize values correct at time of printing.

Who Can Enter

Contest is open to WorldMark South Pacific Club by Wyndham Owners aged 18 years or over who are residents of Australia, Fiji or New Zealand. Employees and/or associates of WorldMark South Pacific Club by Wyndham and the Promoter, Wyndham Vacation Resorts Asia Pacific Pty Ltd ABN 30 090 083 613, are not eligible to win.

How to Enter

Competition can be entered by completing an entry form by calling (AU) 1800 374 363 or (NZ) 0800 440 418, online at www.worldmarksp.com/friendsfirst, in writing and returning to the Promoter by mail/fax/email or when contacted by the Promoter. One entry will be awarded per Valid Referral (where a valid name, phone and state is provided). No additional entry will be given for repeat referrals.  If an Owner provides 10 or more Valid Referrals at any one time an Owner will receive double entries e.g. 10 Valid Referrals provided will receive 20 entries. Owners must ensure that they have the consent of persons they are listing as referrals to list them as such. The Promoter has the absolute discretion to deem whether a contact number is valid or not and names and numbers deemed as fictitious or frivolous by the Promoter may be removed at the Promoters discretion and result in a removal of that entry.

Prize Draws

Prizes guaranteed to be given away by random drawing from all versions of this contest. Odds of winning are based on the actual number of entries received. Entries for each draw must be received by the Promoter twenty one days prior to the draw dates. All non-winning entries received will roll over into subsequent prize draws. Winners will not be excluded from subsequent draws. Neither the Promoter nor any of their agencies or affiliates are responsible for lost, late, damaged, misdirected, incomplete or ineligible entries. The Promoters decision is final and no correspondence will be entered into. In the event a draw date falls on a non-business day, the draw will take place on the next business day. Draws and redraws will be conducted at Wyndham Corporate Centre, Level 7, 1 Corporate Court, Bundall QLD 4217, at 2:00pm AEST on the draw dates. If prizes are not claimed within three months of final draw, an unclaimed prize draw will be conducted subject to any written directions given by the gaming authorities in each state/territory.

Prize Terms & Conditions

Cash: Cash prizes to be issued in the form of a bank cheque in the name of the winner. 2,000 ‘One-Time’ Credits: Prizes will be issued in the form of ‘One-Time’ Credits and can be used for accommodation at WorldMark South Pacific Club resorts, subject to availability. 50,000 ‘One Time’ Credits: Prizes will be issued in the form of ‘One-Time’ Credits and can be used for accommodation at WorldMark South Pacific Club resorts and/or for travel services booked via Travel by Wyndham, subject to availability. ‘One Time’ Credit Terms & Conditions

Booking(s) using ‘One-Time’ Credits must be made within 12 months of draw date(s) and travel can be taken up to 13 months in advance. ‘One-Time’ Credits can be spread over more than one booking but must be used within the applicable expiry date. These ‘One Time’ credits are not transferable or exchangeable and cannot be taken as cash. Winners will assume all responsibility and costs for any and all amounts that may become payable in excess of the ‘One-Time’ Credits to complete their bookings and/or stays. No refunds will be given for any unused portion of ‘One-Time’ Credits. Neither the Promoter nor WorldMark South Pacific Club by Wyndham accepts any responsibility or liability for any portion of the prize not being redeemed by the expiry date. ‘One-Time’ Credits are for one time use and will not be permanently added to your WorldMark South Pacific Club Ownership, and cannot be held in your account or carried forward. When using these ‘One-Time’ Credits, you must abide by the WorldMark South Pacific Club Guidelines and Regulations (refer to Guidelines and Regulations at the back of the WorldMark South Pacific Club Resort Guide). Please note that under the Guidelines and Regulations no reservation requests will be confirmed if an Owner is delinquent in the payment of WorldMark South Pacific Club levies or any amount owed to WorldMark South Pacific Club under the agreement for purchase of Vacation Credits. ‘One-Time’ Credits can be used to complete a reservation where you do not have sufficient Credits in your account, however if used in this instance additional housekeeping fees may be charged. Winners are responsible for all costs associated with any use of ‘One-Time’ Credits, including but not limited to costs for passports, travel transfers, visas, spending money, items of a personal nature, travel insurance, taxes, licensing and/or duties.

Notification

Winners will be notified in writing by mail (in accordance with the timeframes as determined by the applicable Legislation and Regulations) and contacted by phone or email where possible and all winners’ names will be posted on www.wyndhamvrap.com and published in The Australian newspaper on 28/03/12, 25/04/12, 30/05/12, 20/06/12, 01/08/12 and unclaimed prizes on 31/10/12 (if applicable). Prize winners list may be obtained by sending a self-addressed stamped envelope to Winners List, C/- Wyndham Vacation Resorts Asia Pacific, PO Box 7493, GCMC QLD 9726 or visiting www.wyndhamvrap.com.

Promotion

By entering this competition, all prize winners agree to the use of pictures, names and/or statements for future promotional purposes without further payment or consideration. Any contact Wyndham Vacation Resorts Asia Pacific has with entrants may be monitored and/or recorded for training and compliance purposes, and the entrant should advise us at point of contact if they do not wish this to occur. By entering the Competition, an entrant releases and indemnifies the Promoter (including its officers, employees and agents) from and against all actions, liabilities, penalties, claims or demands the entrant may have against the Promoter or that the Promoter may incur for any loss or damage which is or may be suffered or sustained as a direct or indirect result of an entrant entering or participating in the Competition or winning or failing to win a prize, or using or permitting any other person to use the prize, except for any liability which cannot be excluded by law or which would cause any part of these details of participation to be void or unenforceable. The Promoter reserves the right to block, prohibit or withdraw entries where that entry impairs the proper operation of the competition and the Promoter’s business.
